Biztrip Terms and Conditions
Reservations and cancellation policy
Any reservation will be considered confirmed once the estimated rental deposit has been paid.
The cancellation policies for each reservation will correspond to the channel or website through which the reservation was made.
Reservations for more than 30 nights
The payment corresponding to the reservation deposit, the security deposit, the final cleaning and the service fee must be made at least 48 hours before the check-in date.
Payment may be made by bank transfer under the terms previously agreed with a monthly reservation agent and detailed in writing. No reservation can be confirmed if said payment has not been made effective in the bank account provided by the agency. (Any bank transfer costs will be the client's responsibility.
The deposit payment made will not be refundable except for those payments that respond to specific cancellation policies previously agreed with an agent and clearly specified in writing at the time of booking.
The client will receive information on the breakdown of payments to be made during their stay and the dates agreed to satisfy them. In the event that said payments are not made on the agreed dates, the agency may terminate the contract and the client will have to leave the apartment in perfect condition.
Reservations of less than 30 nights:
The deposit payment for the reservation must be made by credit or debit card, through the website as a secure payment.
The deposit payment made will not be refundable except for those payments that respond to specific cancellation policies specified at the time of booking.
7 days before the date of entry, the remaining amount of the rent plus the deposit must be charged to the credit card with which the reservation was made. The transaction must be authorized by the client in accordance with the guidelines of the European Union. If the charge is denied or not authorized, your reservation will be considered automatically cancelled without the right to a refund.
Cancellations made less than 7 days before the check-in date will have a cost of 50% of the reservation.
If the client changes the dates or the apartment, it will be understood as a new reservation and will be subject to the cancellation conditions.
If the client decides to cancel their reservation while occupying the apartment, they will lose the full amount of the reservation.
A reservation will not be considered cancelled if written communication has not been received via email from the client who made the reservation informing them of this.
If the client does not show up (no show) on the day of check-in, they will lose 100% of the reservation.
If the reservation is created within 7 days prior to the day of check-in, the client will pay 100% of the reservation. The corresponding cancellation policy applies in the same way.
The cancellation policies applied to each reservation will be those detailed on the channel or website through which the reservation was made.
In the “Non-Refundable” cancellation policy and thus specified, the client/guest understands that BizTrip/MitHouse is not obliged to make any refund of the amount paid after the creation of their reservation. This policy covers, without exclusion of any other reason, cancellation due to delay or loss of flight, train, public or private transport, any other reason such as conflict situation in the country of origin or destination;
Visa problems with entry to Spain or exit from any other country, including lack, error or denial of any other documentation or permits necessary to travel to Spain; Death; Illness; Accident, or adverse weather conditions and natural disasters.
Payment and confirmation of reservation:
Reservations of more than 30 nights:
The payment breakdown will be established in writing prior to confirmation of the reservation and will depend on the duration of the reservation.
Reservations for less than 30 nights:
The breakdown of payments made or pending will be detailed in the confirmation email for each reservation.
In order to access the apartment, all payments must be paid in advance, including the deposit. BizTrip is not responsible for delays in the delivery of the apartment due to non-payment of any amount.
Deposit
Reservations for more than 30 nights
An estimated amount will be set in writing by a monthly reservation agent prior to making the reservation, and may range from half a month to 2 months of the monthly rental amount of the apartment.
In the event of damage to the apartment caused by misuse, the agency will send a written report to the client and will deduct the cost of repair and/or replacement from the deposit once this has been assessed in the shortest possible time, blocking the cost of the apartment.
Reservations of less than 30 nights:
Before your arrival, a refundable deposit will be required, ranging from €200 to €400 depending on the type of apartment, and will be made by means of a bank pre-authorisation with a credit card, never in cash.
By accepting our Terms and Conditions, the landlord agrees that any damage caused by him and/or his companions will be deducted from the refundable deposit and he will also be responsible for any damage that exceeds the amount of the deposit.
The deposit will be charged and retained by the agency, and will be refunded to the same credit card within a maximum of 7 days after departure from the apartment once the good condition of the same has been verified.
In the event of damage to the apartment caused by misuse, the agency will send a written report to the client and will deduct the cost of repair and/or replacement from the deposit once it has been assessed in the shortest possible time, blocking the deposit during the process until the final resolution.
In the event that the deposit is not sufficient to cover said expenses, the client agrees, having accepted the terms and conditions of BizTrip, to cover said damages immediately.
Check-in and Check-out
Before your arrival
In the booking confirmation email you will find the exact address of the apartment and our offices, contact details, payment breakdown and specific instructions for checking in and out of the reserved apartment. Please note that these may vary depending on the arrival time or the reserved apartment. Please pay attention.
In order to speed up the registration and access process to the apartment and to comply with public safety regulations, the guest and the rest of the occupants must identify themselves prior to the day of entry into the apartment by carrying out the online Check-in.
This process will be carried out through a smartphone or any other mobile device capable of internet access on which the BizTrip application must have been previously downloaded.
Any images and information required for this process will be treated in accordance with current GDPR regulations. For the online check-in process, it will be necessary to enter the guest code that you will have received by email. BizTrip is not responsible for delays in entry due to lack of registration.
Most of our apartments have digital locks for access to the apartment and/or the building. Doors are opened from the same Mithouse application with which you have made the online check-in.
We recommend that all occupants of the apartment download the MitHouse app and complete their check-in process individually, this way all occupants will have access to the apartment from their mobile device.
If the reserved accommodation does not have a digital lock, it will still be necessary to check-in online through our mobile application, and it will also be necessary for you to call us at least 30 minutes before your arrival to be able to arrange a meeting at the apartment address in the best possible way.
During the in-person check-in process, a BizTrip agent will greet you and give you the keys and instructions for the apartment and useful information. Please note that if you have not contacted us in advance with sufficient time, you will have to wait.
Please remember: In-person check-in is between 3:00 p.m. and 2:00 a.m. For arrivals after 21:00 in apartments that require a BizTrip agent to grant access, there will be a late check-in fee of 50 Euros which will be payable on the spot in cash.
The official check-in time is from 15:00. BizTrip will do its best to grant access to the apartment to clients arriving before the official check-in time as early as possible.
Please note that if you make a reservation for the same day, the official check-in time will be from 19:00.
In order to gain access to the apartment, all payments will be required, including the rent and the refundable security deposit for damages.
Please ensure that we have your most up-to-date arrival time, so that we can coordinate your arrival. Keep your contact person at the agency informed at all times of any delays or changes.
For the efficient coordination of daily check-ins into our apartments, our check-in staff will be able to Contact you by phone or email prior to your arrival, with the sole purpose of obtaining more detailed information about your arrival time. To this end, we ask you to be precise with the contact information provided, which you must fill in on your reservation information.

Departure from the apartment:
Departures must be made at 11:00 or earlier. Any unauthorized departure after 11:00 will be penalized.
If you require a later check-out than 11:00, please check availability with the office no later than 24 hours before the official check-out time.
Late check-out will be confirmed by our reservations team in case of availability and the cost of staying in the apartment until 18:00 will be 50% of the rental price per night. Any departure after 18:00 will be subject to the total price per day.
On the day of your departure you must leave your apartment in good condition. Due to municipal regulations, it is forbidden to take out the trash during the day.
The client is obliged to deposit the waste on the street each night during their stay, as established in the building to which the apartment belongs and whose rules will have been indicated to them at Check-in. It is not permitted to leave more than one bag of trash in the apartment upon departure, in which case you will be penalized with €50.
Upon prior notice, the BizTrip/MitHouse team will be happy to reserve a transport for you to leave the apartment.
BizTrip is not responsible for any personal items forgotten in any of our apartments.

Apartment cleaning
BizTrip will deliver the apartment clean and equipped with sheets and towels according to the number of occupants and length of stay. Any additional materials requested will have an extra cost.
Before leaving, the guest is obliged to leave the apartment in perfect condition, having thrown away the trash correctly and picked up the apartment. We always recommend leaving the trash out the night before.
Leaving more than two bags of trash in the apartment may be penalized with €50.
Guest obligations.
The client in whose name the reservation is made, as well as all occupants of the apartment, must show BizTrip their identification upon arrival.
This information will be reported to the national police as indicated by the regulations. In order to comply with the regulations, photographs of the necessary documentation may be required to comply with the requirements set out.
In order to speed up the process of accessing the apartment and comply with public safety regulations, the guest and the rest of the occupants must identify themselves prior to the day of entry into the apartment by doing the online Check-in.
This process will be carried out through a smartphone or any other capable mobile device on which the BizTrip/MitHouse application must have been previously downloaded. Any images and information required for this process will be treated in accordance with current GDPR regulations.
The Check-in must be carried out by the person listed in the reservation. If it is not possible for this person to be present on the day of Check-in, they must have previously informed by email of the name and identification number of the person who authorizes said check-in or entry registration and who will be responsible for the pending payments at that time, as well as the documentation required for the police control. Otherwise, it will not be possible to enter the apartment.
Pets are only allowed if permission has been specifically granted in writing, before making the reservation. If you are unsure, we recommend that you contact BizTrip before making your reservation.
The Guest agrees to allow the entry of authorized BizTrip personnel sent to carry out an inspection of the condition of the property in the event of an emergency or maintenance, of installations that affect the general services of the property or that cause damage to the adjoining apartments.
In the event of refusal to allow access, the Guest will be directly responsible for the damages and losses caused, regardless of the legal actions that may be taken against the Guest.
In the event that any infringement of the aforementioned obligations is committed, BizTrip, at its own discretion, will have the right to ask the Guest to leave the apartment, and the Guest will not have the right to claim any type of compensation.
Behavior during the stay
Loud music and parties are prohibited. Failure to comply with this rule may result in the automatic loss of the deposit.
Rest hours are from 10:00 p.m. to 10:00 a.m. We greatly appreciate your cooperation in this matter and hope that you understand that these rules are necessary for proper coexistence. All our apartments have noise control systems and if an alarm is detected, you will receive a warning that must be respected.
If you do not comply with this rule, BizTrip/MitHouse may instruct you to vacate the apartment without the right to receive any amount.
The client, by accepting the terms and conditions of BizTrip during the online check-in process, will be subject to correct and decent behavior on their part, as well as being responsible for the rest of the occupants.
If this is not the case, BizTrip will have the right to ask the client and the people accompanying him to leave the apartment without any right to future claims or any compensation. This will also mean the loss of the prepaid rent and the refundable security deposit.
Smoking is prohibited in the apartment. In case of non-compliance with the rule, the guest will be penalized by the non-refund of his deposit.
It is not permitted to carry out any commercial or photographic event, or commercial recording in the property without the express written authorization of BizTrip.
By booking with BizTrip you are accepting our terms and conditions. These rules are also doubly accepted during the online check-in process.
Neither BizTrip nor the owner of the apartment will be responsible for any direct or indirect damage that may occur as a result of the client's use of the apartment, including without limitation damages, insurance, losses due to fire, theft or criminal behavior.
In the event of any breach of the aforementioned obligations, BizTrip/MitHouse shall have the right, at its own discretion, to ask the client to leave the apartment, and the client shall not be entitled to claim any type of compensation.
Applicable Law and Jurisdiction
In cases where the regulations provide the possibility for the parties to choose the applicable law, both parties, expressly waiving any other laws that may apply to them, shall be governed by the rules of the Spanish legal system.
In cases where the regulations provide the possibility for the parties to submit to a jurisdiction, both parties, expressly waiving any other jurisdiction that may apply to them, submit to the Courts and Tribunals of the city of Madrid (Spain).

Fines del tratamiento a que se destinan los datos personales
Los datos personales son recabados y gestionados por Contracorriente Inversiones, S.L. con la finalidad de poder facilitar, agilizar y cumplir los compromisos establecidos entre el sitio web y el usuario o el mantenimiento de la relación que se establezca en los formularios que este último rellene o para atender una solicitud o consulta.

Categorías de datos personales
Las categorías de datos que se tratan en Contracorriente Inversiones, S.L. para gestionar los tratamientos anteriormente mencionados son:
Identificativos: Nombre, apellidos, DNI o NIE, Pasaporte, domicilio, teléfono, correo electrónico, fotografías o audios de voz.
Personales: Fecha y lugar de nacimiento, edad.
Económico-financieros: Datos bancarios, datos tarjeta de crédito o débito.
Dirección IP.
Informamos que los datos requeridos son indispensables para poder llevar a cabo los servicios solicitados, implicando su negativa a suministrarlos la imposibilidad de desarrollar los mismos.
La información que el Usuario facilite a Contracorriente Inversiones, S.L. a través de los formularios deberá ser exacta y veraz. El usuario garantiza la autenticidad de todos los datos que comunique y mantendrá actualizada la información dada a Contracorriente Inversiones, S.L. a fin de que corresponda, en todo momento, con la situación real del Usuario. En el supuesto de manifestaciones inexactas, incompletas o falsas comunicadas por el Usuario, éste será el único responsable por los perjuicios que debido a ello se pudieran causar a Contracorriente Inversiones, S.L. o a terceros.
Base legal para el tratamiento de los datos personales
La base legal para el tratamiento de los datos personales es el consentimiento expreso y explícito otorgado por el usuario en cada caso, pudiendo retirar el mismo en cualquier momento.
Respecto de la gestión de la contratación de servicios, pago, facturación, la base de legitimación del tratamiento de sus datos de carácter personal se establece en la propia necesidad de dicho tratamiento para la ejecución del contrato.
En cuanto al tratamiento de los datos de carácter personal siguientes: Nombre. Primer apellido. Segundo apellido. Sexo. Numero de documento de identidad. Número de soporte del documento. Tipo de documento (DNI, pasaporte, TIE). Nacionalidad. Fecha de nacimiento. Lugar de residencia habitual. – Dirección completa. – Localidad. – País. Teléfono fijo. Teléfono móvil. Correo electrónico. Número de viajeros. Relación de parentesco entre los viajeros (en el caso de que alguno sea menor de edad); la base legal es el cumplimiento de lo establecido en el Art. 4.1 del Real Decreto 933/2021, de 26 de octubre, por el que se establecen las obligaciones de registro documental e información de las personas físicas o jurídicas que ejercen actividades de hospedaje y alquiler de vehículos a motor y su Anexo I.
En cuanto a las fotografías de los documentos de identidad y/o pasaportes, así como los “selfies”, para cumplimentar la obligación legal de identificación contenida en el Art. 4.3 del precitado Real Decreto 933/2021, de 26 de octubre y 25.1 de Ley Orgánica 4/2015, de 30 de marzo, de protección de la seguridad ciudadana, todo ello al amparo del Art. 9.2.g) del Reglamento 2016/679/UE, de 27 de abril, de Protección de Datos.
En cuanto al envío de comunicaciones comerciales y solicitud de encuestas de satisfacción la base legitimadora consiste en el interés legítimo de Contracorriente Inversiones, S.L. para la mejora de la calidad de los servicios prestados, así como para la actualización de información sobre los servicios prestados por la empresa a sus clientes.
Períodos de retención de los datos personales
Los datos personales solo serán retenidos durante el tiempo mínimo necesario para los fines de su tratamiento y, en todo caso, hasta el cumplimiento de plazos derivados de obligaciones legales, administrativas o contractuales.
Destinatarios de los datos personales
Los datos personales del usuario serán compartidos con los Cuerpos y Fuerzas de Seguridad del Estado en labores de policía y con las entidades bancarias y plataformas de pago correspondientes para la facturación y cobro de los servicios prestados.
Los datos biométricos, fotografías de documentos de identidad o “selfies” necesarios para la identificación del cliente a la hora de la realización del proceso de Check-in serán cedidas a la empresa VIPTHINK, S.L., domiciliada en Pozuelo de Alarcón, plaza San Juan, número 2, 1º, derecha, C.P. 28224 y C.I.F. número B-87609418, encargada de la gestión de la APP HoomVip de auto check-in y apertura de cerraduras y puertas del alojamiento. El cliente manifiesta expresamente estar conforme con esta cesión de datos personales.
Datos personales de menores de edad
Respetando lo establecido en los artículos 8 del RGPD y 7 de la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales, solo los mayores de 14 años podrán otorgar su consentimiento para el tratamiento de sus datos personales de forma lícita por Contracorriente Inversiones, S.L. Si se trata de un menor de 14 años, será necesario el consentimiento de los padres o tutores para el tratamiento, y este solo se considerará lícito en la medida en la que los mismos lo hayan autorizado.
Secreto y seguridad de los datos personales
Contracorriente Inversiones, S.L. se compromete a adoptar las medidas técnicas y organizativas necesarias, según el nivel de seguridad adecuado al riesgo de los datos recogidos, de forma que se garantice la seguridad de los datos de carácter personal y se evite la destrucción, pérdida o alteración accidental o ilícita de datos personales transmitidos, conservados o tratados de otra forma, o la comunicación o acceso no autorizados a dichos datos.
Los datos personales serán tratados como confidenciales por el Responsable del tratamiento, quien se compromete a informar de y a garantizar por medio de una obligación legal o contractual que dicha confidencialidad sea respetada por sus empleados, asociados, y toda persona a la cual le haga accesible la información.
